Labour Agreements

A Labour Agreement is a formal arrangement negotiated between Australian businesses and the Department of Home Affairs. A Labour Agreement can be negotiated when there is a demonstrated need for skilled labour which cannot be met within the Australian Market. Once approved, it provides visas for specific types of international workers.

Labour Agreements Primary Information

Labour Agreements in Australia are formal arrangements between employers and the Australian government that allow for the recruitment of overseas workers when there is a demonstrated labor shortage that cannot be met by the domestic workforce. These agreements are crucial in addressing specific labor market needs and ensuring that businesses can access the skills and labor required to operate effectively.

Key Points:

  1. Customized Solutions: Labour Agreements are tailored to meet the specific needs of employers and industries facing skill shortages. They can cover a wide range of occupations and industries.

  2. Streamlined Processes: Once a Labour Agreement is in place, it provides a more streamlined process for sponsoring and employing overseas workers compared to standard visa programs.

  3. Temporary and Permanent Workers: Labour Agreements can cover both temporary and permanent work arrangements, depending on the labor market needs of the employer.

  4. Consultation: Employers seeking a Labour Agreement must engage in a consultation process with the Department of Home Affairs and may need to demonstrate their efforts to employ and train local workers first.

  5. Requirements: Employers must adhere to specific terms and conditions outlined in the Labour Agreement, including wages, working conditions, and compliance with Australian employment laws.

  6. Duration: Labour Agreements have a specified duration and must be reviewed and renewed periodically.

  7. Benefits: Labour Agreements benefit both employers and the Australian economy by ensuring that businesses have access to the skills they need to grow and remain competitive while also contributing to local job creation.

Labour Agreements play a vital role in addressing labor shortages and supporting economic growth in Australia. They offer a pathway for employers to bring in overseas workers when local talent is insufficient, helping to meet the workforce demands of various industries. For businesses interested in pursuing a Labour Agreement, it is advisable to consult with an experienced migration agent or legal expert who can navigate the application process and ensure compliance with all relevant regulations.

Labour Agreement Streams

Nominating employers must be party to a Labour Agreement Stream that relates directly to the visa application for a particular foreign worker.

The four main types are:

Industry Labour Agreement

Industry labour agreements are negotiated for specific industries with fixed terms and conditions. The industry must show ongoing labour shortages and extensive consultation within the industry.

Industries included in this labour agreement stream include:

    • Aged Care
    • Advertising
    • Fishing Industry
    • Dairy industry
    • Snow Sports
    • Meat industry
    • On-hire labour industry
    • Pork Industry

Designated Area Migration Agreements (DAMA)

This stream is an agreement between the Australian Government and regional, state or territory authorities to bring workers to specific areas.

The DAMA stream is designed to help support targeted areas of Australia that need the support of overseas workers.

There is a broader range of occupations available under a DAMA, and each DAMA related to an area has its own conditions

Project Labour Agreements

Project Agreement streams allow infrastructure or resource development projects which need more skills or labour to access workers from overseas.

These agreements are made to complement existing Australian Government initiatives, to address shortages in labour and skills, and  to prevent any possibility of jeopardising major projects and threats to Australian jobs.

Company Specific Labour Agreements

This stream is negotiated directly between the Department of Home Affairs and a business who wishes to employer foreign workers. There must  be a genuine need for a certain skillset for which there is a shortage in the Australian labour market.

The conditions for a Company Specific Agreement are considered on a case-by-case basis.
